In Indiana, a business or debt collector has only six (6) years to file a lawsuit on you from the day you last made a payment. This means that if you made your last payment on your credit card on January 1, 2010, the credit card company or a debt collector can only take you to court on it until January 1, 2016. If they file a lawsuit against you after this date an attorney may be able to help you get it dismissed. An attorney may even be able to file a Fair Debt Collection Practices Act lawsuit against the debt collector which may bring you damages of up to $1,000!
A few of our Clients have been calling in reports of lawsuits being filed by Cach, LLC, that are outside the 6 year Statute of Limitations. Even though the records from their banks state the last payments were made in 2010, Cach, LLC, is making statements in their lawsuits that the Clients had made payments as late as March 2015. Not true!
